ErgoSafe AB has recently won a lawsuit against Filip Piòrowski, representing the trade name Wind-Dam Balustrade System.
Stockholm District Court have unanimously, in a case concerning breach of a settlement agreement, ruled in favor of ErgoSafe in the legal proceedings against Filip Piòrowski. The court ruled that Piòrowski should pay Ergosafe 100,000 Euro in fines as well as incurred court costs.
The ruling concerns continued infringement on ErgoSafe’s registered EU design, which applies to the height-adjustable glass balustrade ClickitUp®. This product has been the subject of copying and illegal sale on the European market for several years, despite repeated warnings from ErgoSafe about infringement of their intellectual property rights.
This legal success is not only a win for ErgoSafe, but it also shows that it is worth investing money in your own innovations and protecting them. It sends a strong signal to the market that imitating or copying a protected product, without permission is unacceptable and will lead to legal consequences.
ErgoSafe will now continue developing and market ClickitUp®, strengthening their position as a leading producer of height adjustable glass balustrades.
